Services:

Seller:

WHEREAS the Agent has experience in marketing, advertising, and selling real estate property and has expressed an interest to provide these services for the Seller,
The Parties have entered into this real estate agency agreement on their own free will and agree to the following:

The Seller hereby grants the Agent exclusive rights to sell the property.
The Seller will provide the Agent with all relevant information necessary for the property to be sold.
Any and all offers and negotiations in regards to this property shall be conducted by the Agent.

It is the Agent’s sole purpose to sell the property and as so will be permitted to employ additional Brokers to assist in the selling and advertising process.
Any offers considered valid should be reported to the Seller  and will be at the Sellers discretion to accept or decline.The Agent shall remain an independent contractor and as such will be responsible for managing hours worked in order to fulfill the obligations of this real estate agreement.

The seller must disclose all the necessary details about the property to the buyer and the real estate agent. There shall not be any court cases pending, legal issues or any litigation regarding the property.
While handling the property to the buyer on the time of registration there shall be no dues like EB, water tax, property tax, income tax,drainage tax etc from the seller side.

Buyer:

Sending property details,photos,videos and google location pin are the service provided by the real estate agent.
And also arranging for site visit, providing documents, sketch, FMB to the buyer are additional services of the real estate agent.

Once the deal is confirmed between the buyer and seller, Agent should collect all the necessary documents from the seller for legal purposes.
Even if the buyer collects the documents from the seller in person with or without agent’s knowledge no percentage of the commission shall be reduced for the real estate agent.
It is the sole responsibility of the buyer to check all the legal procedures of the document before buying the property on his own expense.

Payment:

The Seller and purchaser has agreed to pay the Agent a commission of 2% from seller and 1% from purchaser from the property final sale price.
Once the deal is completed, the Seller and purchaser should pay the full sale commission without any balance to the agent on the date of registration without fail. Furthermore, if this real estate agency agreement shall terminate for any reason, any offers agreed on by the Seller as a result of the other Agent’s services shall result in the Agent being paid said commission percentages.
The Agent shall be responsible for all marketing cost and travel expenses incurred during the execution of this real estate agency agreement, including any additional broker fees incurred.

The Agent shall for the term of this real estate agency agreement be considered an independent contractor. This real estate agency agreement does not serve as employment of the Agent by the Seller.
The seller must pay 1% TDS for the selling amount if the value of the property is more than 50 lakhs. If the seller request to pay TDS, the purchaser can pay TDS on the account of seller . The TDS amount will be deducted from the total sale value. Therefore, the Agent will not be responsible for any federal and local taxes due on any commissions paid from this agreement.​

Confidentiality:

The Agent agrees to keep all information deemed confidential and not necessary for the sale of the property private.
Any needed disclosures of confidential information shall be provided to the Seller for approval prior to such disclosures taking place.

Return of Property:

If the seller is not willing to sell the property or not interested to publish in electronic media they can request to remove the property details in such media.
Upon the conclusion or termination of this real estate agency agreement, the Agent will return all of the following

  • Keys
  • Signs
  • Layouts
  • Property Documents

Entire Agreement:

This real estate agency agreement along with any attached documents shall constitute the entire agreement between the Parties.
This agreement shall overrule any previous agreements either verbal or written between the parties prior to entering into this Real estate agency agreement.
This real estate agreement may be amended with prior written consent between the Parties.

Applicable Law:

This real estate agency agreement shall remain under the jurisdiction of Chennai.
The Galaxy Digital Marketing / Real estate company / Associates / Agents  start the marketing activities after the seller confirmation and approval via written/Electronic media. If The seller is not willing to sale the property or not interested to published in electronic media they can request to remove the property details in such media based on Section 77 in The Information Technology Act, 2000  Any and all legal proceeds occurring from this real estate agency agreement shall be conducted under the above jurisdiction. As per the THE INFORMATION TECHNOLOGY ACT, 2000 in article  “Authentication of electronic records”  Whatsapp, email, SMS, phone calls and other electronic records will be considered for proof.
